Terms Of Service

Terms:
I will provide you with quality and professional copywriting services. All projects are completed quickly and accurately according to your specifications. Your satisfaction is my ultimate goal.

 

Service Includes:

  • Gathering information in order to determine your wants and needs
  • Reviewing all materials in detail
  • Offer feedback, unique ideas and fresh concepts for your individual project
  • Research, meetings and interviews
  • Scheduled teleconferences (as needed)
  • Completed project polished and accurate
  • Up to two revisions
  • Detailed scope of the project

 

Payment Terms:
I will provide you with a Service Agreement Form outlining the project as you describe it. 50-percent of the payment is due at the onset of the project. I will provide you with an invoice once the project is complete to be paid within 30 days of completion.

 

Revisions:
Two revisions are included with each project. If you require revisions, I will work quickly to provide another draft reflecting the necessary changes.  All revision requests must be made within 30 days of the client receiving the copy. Revision requests beyond the initial two revisions offered will be billed at the standard hourly rate.

 

Rights to the Final Work:
You have 100-percent ownership rights and a non-exclusive irrevocable, worldwide royalty free license upon completion and receipt of final payment.

I reserve the right to use any and all finished product for promotional purposes, such as samples, to prospective clients. Writing sample media include and are not limited to websites, e-zines, brochures, portfolios and press kits.

 

Indemnification:
You indemnify Kimberly Ben from any claims or lawsuits as a result of copywriting services provided by Kimberly Ben.

Kimberly Ben indemnifies you against any claims or lawsuits as a result of any work provided by Kimberly Ben that was not approved by you or by vendors used to prepare said work.

 

Intellectual Property Rights:
I agree to grant you a non-exclusive, irrevocable, worldwide royalty free license to use, copy and modify any elements of the material used or specifically created for you as part of the services, I assign full title guarantee to you and all of the copyright, other intellectual property rights and any other data or material used or subsisting in the material whether finished or unfinished. If any third party intellectual property rights are used in the material I will ensure that it has secured all necessary consents and approvals to use such third party intellectual property rights for the parties.  The term “materials” shall mean the materials, in whatever form, used by the service provider to provide the services and the products, systems, programs or processes, in whatever form, produced by the service provider pursuant to this agreement.

I will not be held liable for content or materials supplied by you to complete said project.

 

Client Approval:
You are responsible for written approval of work ordered required for the completion of this project. The approval can be in the form of a signature on this agreement. Upon acceptance of the completed project, you accept responsibility for any further processes in which this work is used (i.e. printing, etc.) Writer is not responsible for errors occurring in this work or projects related to this work after acceptance of this project.

 

Expenses:
You will not be charged for minor, out-of-pocket expenses required to complete this project. This includes phone, fax, Internet, e-mail and courier. In the uncommon event that an expense needs to be charged, you will be notified in advance for approval.

 

Cancellation:
Should you need to cancel or place the project on hold, you will be invoiced for all work completed to this date. You are responsible for payment of all expenses incurred and any work done based on the percentage of the project already completed at the time of cancellation. Should you cancel the project following its completion, you are responsible for full payment as per the above estimate.

 

Errors and Omissions:
 I make every effort to ensure the copy I submit to you is free of errors and omissions. This includes spelling errors and content; however, I cannot guarantee this. I suggest you review the copy thoroughly before committing to production.

 

Payment and Collection:
 At least 50-percent of the payment is required at the beginning of each new project unless otherwise specified and agreed to by both parties. This amount is non-refundable. Payments are made payable via PayPal. You agree that the purchase of the services described herein constitutes doing business in the state of Georgia and submits itself to the jurisdiction of the state of Georgia with respect to any suit brought to Kimberly Ben to
collect any sums hereafter.

Due to the nature of online services, charge backs, stop pays or any attempt to stop payment will be considered theft and treated as fraud. Services once rendered cannot be returned as you are buying the service provider’s time and skill in addition to a finished “product.” The client is responsible for charge backs and will face severe legal consequences and penalties.
